Lawyer In Dallas Files Suit To Offer Texas Poker Services Legally

Texas SealWhile most of the effort in Texas has been geared towards trying to increase live poker that is legal by reintroducing Texas Hose Bill 222, a lawyer in Dallas, David Tucker, has recently filed a civil suit against Texas, as well as the city of Dallas, in trying to get his business concept for spreading poker to be declared legal in the state.

The suit is Pick-Up Poker Inc. vs. the State of Texas and the City of Dallas, is seeking a judgment of declaration to relieve Tucker’s business, which is Pick-Up Poker, from “uncertainty and insecurity with respect to rights, status and other legal relations” in regards to live poker.

Founded in December of last year, Pick-Up Poker is planning to lease poker rooms that are furnished to private parties of poker players to use them in the player’s home games that would be legal.

The lawsuit was filed by Tucker in order to clarify the business plan and its standing as being different from Texas underground poker games, as well as to fight the state’s gambling statutes that are currently in place in Texas. The current statutes in the state see poker games in the state as “public nuisances.” Pick-Up Poker is trying to position themselves as being a “cashless poker system” where poker players would deposit money with the company, play with their chips, and then have refunds issued on the chips later. This approach, which is quite unique, is set up in order to set it apart from underground poker games.

Many underground poker games have been victimized by robberies in the past few months.
